1.- COMPANY ORGANIZING THE PROMOTION

The Company FANCYHAUS SL with address at C/ Santa Amelia 37, 08034, Barcelona, and identified with the number B67306407 organizes the draw (hereinafter, "the Promotion") of national scope, to be developed through the Internet, exclusively for users residing in Spain in accordance with the provisions of the participation requirements section. The purpose of this sweepstakes is to reward the loyalty of the followers of the Fancyhaus brand.

2.-START AND END DATES

The Promotion starts on 07/03/2024 at 13:30 and ends on 15/04/2024 at 23:59h.

The Company reserves the right not to proceed with the promotional action or to extend the termination of the promotional action if deemed necessary for reasons of participation or technical difficulties in selecting the winner.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The requirements for participation are as follows: Participation will be open to those persons residing in Spain and over 18 years of age. Only participants who have an Instagram account will be able to participate. Participants must comment on the publication of the brand @fancyhaus on the social network Instagram as well as its founder @iondraghita and tagging 2 friends during the participation period.

Participants may only participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles they will be disqualified.

CONDITIONS OF THE PROMOTION AND PRIZES 

The winner will be chosen by means of a platform specialized in choosing winners randomly. The prize will be in products available in stock of the Fancyhaus brand, with a maximum value of 300€ RRP including VAT in Spain, and cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration.

The shipping of the products will be included in the price and will only be sent in Spain peninsula.

The Company reserves the right to modify the prize if on the day of declaring the participant as the winner there are problems of stock of the same and, therefore, impossibility to give the same.

The winner may contact the Company during a period of 3 days from the date on which it is announced on the social profile of the brand. If no such contact is made within the stipulated period, the sweepstakes will be declared void or another winner will be assigned, according to preference.

The holding of the draw and the awarding of the prize are subject to the tax regulations in force.

5.- DISQUALIFICATIONS AND PENALTIES

If it becomes evident that any of the Participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion. The Company reserves the right to declare the sweepstakes void.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or that could violate the rights of third parties will not be allowed.

Comments against an individual that violate the principles of the right to honor, to personal and family privacy and to one's own image will not be allowed. We shall not be held responsible for any damage caused by the comments made by the Participants in the Promotion, which at any time could hurt the sensitivity of other Participants. The participation in this Promotion, as well as the publication of the comments made by the Participants in the publications may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use.

If fraudulent means of participation, such as the use of bots in the comments, are discovered by the Company, the prize will not be awarded and will remain the property of the Company.

7.-EXONERATION OF LIABILITY

By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant with respect to the prize obtained from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous event that may prevent the Promotion from being carried out or the total or partial enjoyment of the prize.

In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.

8.- PROTECTION OF PERSONAL DATA

The Company responsible for the treatment of your data is FANCYHAUS S.L.

In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents that their personal data are incorporated into a file, owned by it, in order to manage the draw, as well as disseminate and publicize their results, and process the delivery of the prize. Please note that you can exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to [email protected] by attaching a copy of an identification document. Without prejudice to any other administrative remedy or legal action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in the event that he/she considers that the processing of his/her personal data is not in compliance with the regulations, as well as in the event that the exercise of his/her rights is not satisfied. Therefore, the Participant declares to have been informed of the conditions on personal data protection by accepting and consenting to the processing.

9.- CHANGES AND ACCEPTANCE

We reserve the right to modify or extend these Promotional Terms and Conditions, to the extent that it does not prejudice or undermine the rights of the Participants in the Promotion. The mere fact of participating in the sweepstakes implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the Instagram social network through which the sweepstakes takes place.

10.- APPLICABLE LAW AND JURISDICTION

These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the Participant's city of residence will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
