LEGAL BASIS FOR PARTICIPATION IN THE DRAW OF 4 GIFT CARDS OF 300€

1.- COMPANY ORGANIZING THE PROMOTION
The Company FANCYHAUS SL with registered office at C/ Santa Amelia 37, 08034, Barcelona, and identified with the number B67306407 organizes the sweepstakes (hereinafter, "the Promotion") of national scope, to be developed through the Internet, exclusively for users residing in Spain in accordance with the provisions of the participation requirements section. The purpose of this sweepstakes is to reward the loyalty of the followers of the Fancyhaus brand.
2.- STARTING DATE AND ENDING DATE
The Promotion starts on 07/03/2024 at 13:30 and ends on 15/04/2024 at 23:59h.
The Company reserves the right not to proceed with the promotional action or to extend the end of the promotional action if deemed necessary for reasons of participation or technical difficulties to select the winner.
3PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
The participation requirements are as follows: Participation will be open to those persons residing in Spain and over 18 years of age. Only those Participants who have an Instagram account will be able to participate. Participants must comment on the publication of the brand @fancyhaus on the social network Instagram as well as its founder @iondraghita and tagging 2 friends during the participation period.

Los Participantes sólo podrán participar con un único perfil de Instagram. Si se detecta que un Participante participa con varios perfiles de Instagram serán descalificados.
4.- CONDICIONES DE LA PROMOCIÓN Y PREMIOS
Se elegirá al ganador por medio de una plataforma especializada en elección de ganadores de forma aleatoria. El premio será en productos disponibles en stock de la marca Fancyhaus, siendo un valor máximo de 300€ PVP con IVA en España incluido, y no se podrá canjear por dinero en metálico o por cualquier otro premio, ni puede ser objeto de cambio o alteración.
The shipping of the products will be included in the price and will only be sent in Spain peninsula.
The Company reserves the right to modify the prize if on the day of declaring the participant as winner there were problems of stock of the same and, therefore, impossibility of being able to give the same.
The winner may contact the Company within a period of 3 days from the date on which it is announced on the social profile of the brand. If no such contact is made within the stipulated period, the sweepstakes will be declared void or another winner will be assigned, according to preference.
The celebration of the sweepstakes, as well as the awarding of the prize are subject to current tax regulations.
5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion. The Company reserves the right to declare the sweepstakes void.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or that could violate the rights of third parties will not be allowed.
Comments against an individual that violate the principles of the right to honor, personal and family privacy and self-image will not be allowed. We shall not be held responsible for any damage caused by the comments made by the Participants in the Promotion, which at any time could hurt the sensitivity of other Participants. The participation in this Promotion, as well as the publication of the comments made by the Participants in the publications may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use.
If it is discovered by the Company the use of fraudulent means for participation, such as the use of bots in the comments, the prize will not be awarded and will remain the property of the Company.
7.- DISCLAIMER
By way of example, but not limitation, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant with respect to the prize obtained from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous event that may prevent the Promotion from being carried out or the total or partial enjoyment of the prize.
In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.
8.- PERSONAL DATA PROTECTION
FANCYHAUS S.L. is the company responsible for the treatment of your personal data.
In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents that their personal data are incorporated into a file, owned by it, in order to manage the draw, as well as disseminate and publicize their results, and process the delivery of the prize. Please note that you can exercise your rights of access, rectification, deletion, opposition, limitation of treatment, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to hello@fancyhaus.com enclosing a copy of an identification document. Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in the event that he/she considers that the processing of his/her personal data is not in compliance with the regulations, as well as in the event that he/she does not see the exercise of his/her rights satisfied. Therefore, the Participant declares to have been informed of the conditions on personal data protection by accepting and consenting to the processing.
9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional rules, to the extent that it does not prejudice or undermine the rights of the Participants in the Promotion. The mere fact of participating in the sweepstakes implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the Instagram social network through which the sweepstakes takes place.
APPLICABLE LAW AND JURISDICTION
These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participant will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
