These General Terms and Conditions of Sale (the "Terms and Conditions") apply to the sale of all FANCYHAUS products.
Please read these terms and conditions carefully before placing your order with FANCYHAUS (FANCYHAUS, SL). By placing your order, you agree to be bound by these terms and conditions.

Registering with FANCYHAUS is free of charge.
You are not required to register and can unsubscribe at any time.
The information we receive when you register is completely confidential and only FANCYHAUS or its partner companies will have access to the data, which will be subject to our PRIVACY POLICY.
2. Information prior to contracting
These general terms and conditions, together with any specific terms and conditions that may be established, shall expressly govern the relationship between FANCYHAUS S.L., with registered office at C/ Santa Amelia 37 (Barcelona), with Tax Identification Number B67306407, registered in the Barcelona Mercantile Registry, in volume 46673, folio 114, page B-527331, Entry 1, and the Customers who contract the Products offered through the Website:
These General Terms and Conditions have been drawn up in accordance with Spanish law, specifically Law 34/2002 on Information Society Services and Electronic Commerce, Law 7/1998 on General Contract Terms and Conditions, and Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, Law 3/2014, of March 27, amending the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, Law 7/1996 on Retail Trade, Law 59/2003, of December 19, on electronic signatures, and any other applicable legal provisions.
The use and/or purchase of FANCYHAUS products, whose characteristics are described on the FANCYHAUS website, hereinafter referred to as the "Products,"Products", implies acceptance as a Customer, without reservations of any kind, of each and every one of these General Conditions, as well as the Specific Conditions that, where applicable, govern the purchase.
FANCYHAUS informs that the procedures for purchasing the Products are those described in these General Terms and Conditions, as well as any other specific procedures indicated on the screen while browsing our website, such that the Customer declares that they are aware of and accept these procedures as necessary in order to access the Products offered on the website.
Any modification and/or correction of the data provided by Customers during browsing will be possible and must be carried out in accordance with the instructions included on the website.
The products offered on the website, along with their characteristics and prices, will appear on the screen. We try to show the physical characteristics of the Products, but it should be noted that the quality, configuration, and resolution of the computer monitor may influence the perception of colors, so there may be a slight difference in color between the actual product and the one displayed on the screen.
Although we strive to ensure that the information on our website is complete, sometimes the packaging and materials of the Products may contain additional or different information from that which appears on our website. Components may also change. We recommend that you do not rely solely on the information available on our website, but also carefully read the labeling, warnings, and instructions accompanying the product before use.
FANCYHAUS reserves the right to decide at any time which products are products it offers to Customers through its website. Thus, FANCYHAUS may at any time include new products or modify those included on the website, it being understood, unless otherwise specified, that such Products shall be governed by the provisions of the General Conditions in force at that time. Likewise, FANCYHAUS reserves the right to stop providing access, at any time and without prior notice, to any of the Products offered on the website.
3.Purchase procedure
3.1 Registration
For the purchase of Products, FANCYHAUS requires you to register, for which you must be of legal age (18 years old), and you must complete the forms that appear on the screen, specifically: (i) complete the electronic form that appears on the website at any given time, following the instructions indicated therein.To complete your order, you must click on "PAY NOW," thereby confirming that you have read and accepted the PRIVACY POLICY, TERMS OF SALE, etc.
3.2 Completing the order
Once registered, and in order to proceed with the purchase of any of the Products, you must follow the instructions on the screen, filling in the order form provided for this purpose, which implies the reading and irrevocable acceptance of each and every one of these General Conditions, as well as, where applicable, the existing Specific Conditions.
When you place your order, we will send you an email confirming receipt of your order. However, you can modify your order before it enters the shipping process.
We only sell products in quantities corresponding to the typical needs of an average household. This applies both to the number of products ordered in a single order and to cases where the customer chooses to place several orders for the same product and these individual orders comprise the typical quantities necessary to meet the needs of an average household.
4. Shipping and delivery
4.1 Shipping costs: the shipping cost of the Product to your address depends on the quantity, weight, and shipping area. This will be indicated on the website when you confirm your purchase of the Product.
For areas outside mainland Spain, customs duties at destination and local taxes are not included.
4.2. Delivery: FANCYHAUS will attempt to deliver the Product you have purchased as quickly as possible to the address you have indicated for this purpose on the order form. The delivery time will be indicated in the purchase confirmation email provided for in section 3.2. of these General Conditions.
If, upon delivery by the carrier, you find any non-conformities or visible damage to the goods, you must note this on the carrier's delivery note and notify us within 48 hours of receiving the order by contacting FANCYHAUS at hello@fancyhaus.com. In any case, you must always verify that the goods have been delivered in perfect condition and it is recommended that you note "damaged packaging" or similar on the carrier's delivery note in order to be able to make a claim later, as otherwise the carrier will consider the product to have been received in good condition.
4.3. Delivery times: delivery times for Products, in working days, except for transport problems beyond FANCYHAUS's control, are those confirmed in the order confirmation message.
FANCYHAUS will make every effort to meet these deadlines, but delays due to transportation issues beyond FANCYHAUS's control will not result in the cancellation of the order or any compensation.
4.4. Deliveries outside the EU: when placing an order for delivery to a country or territory outside the European Union, you may have to pay import duties and taxes upon arrival at the destination. This is because you will be considered the importer of the products.products, so you must comply with all applicable laws and regulations in your country. Orders destined for the Canary Islands, Ceuta, and Melilla are subject to local customs procedures.
Any additional expenses due to customs duties and/or tariffs will be your responsibility. FANCYHAUS has no control over such expenses and therefore cannot anticipate their amount. As customs policies vary significantly from country to country, we advise you to contact the relevant customs office for information on import restrictions that apply to certain products. We are not responsible for this. for customs holds. If you do not pay the applicable import taxes, the goods may be held at customs. In this case, returns will not be accepted.
5.- Price and payment method
5.1. Price: The purchase prices in effect at the time the order is placed are those that appear on the screen. Prices will include Value Added Tax (VAT).
However, purchases made by residents of non-EU countries will be exempt from VAT and subject to the applicable import tax. Customs clearance fees and import taxes are not included in the price of the Product or shipping costs and must therefore be paid at the destination.
Due to their special tax regime, the geographical areas corresponding to the Canary Islands, Ceuta, and Melilla are considered non-EU territories for these purposes.
In general, any taxes, fees, duties, and brokerage fees incurred as a result of the purchase of the Product, as well as any other expenses arising therefrom, shall be borne by you.
The shipping costs that appear on the screen will be at your expense and will correspond to the rates set by the transport agency contracted at the time, and will depend on the destination and weight of the shipment.
Prices are shown in EUROS and will be invoiced and charged in this currency.
5.2. Payment method: when you add the Product to the 'Shopping Cart', the amount of said product with and without VAT will appear on the screen or, if the purchase is exempt from said tax, said exemption will be automatically applied based on the personal data you have entered, once you have confirmed the order. Payment of the price of the purchased Product purchased and the shipping costs, which will appear on the screen, can be made by credit or debit card, or PayPal. To proceed with payment, you must follow each and every one of the instructions that appear on the screen, providing the following information, if paying by credit or debit card: a) type of card; b) name and surname(s) of the cardholder; c) card number; c) expiry date; d) as well as any other information required on the screen.
As an electronic payment system, FANCYHAUS has installed an e-commerce payment gateway that it has contracted with a banking institution. All data provided for this purpose is encrypted to ensure maximum security.
5.3. SSL Protocol: Browsing and purchasing on the website are carried out using SSL protocol, thus providing both the customer and FANCYHAUS with the highest standards of confidentiality and security in communications.
This protocol is universally supported by major browsers and guarantees (i) the identity of the recipient of your data (no impersonation of the seller), (ii) the confidentiality of the information provided, and (iii) the integrity (no manipulation) of the information provided.
Likewise, FANCYHAUS states that under no circumstances does it store the data provided by users through the payment gateway, and that it is only retained while the purchase is being made, the payment is being processed, and until the withdrawal period has elapsed. In order to provide greater security to credit card owners, a three-digit number has been included on your cards that serves as an identification code to verify the physical presence of the card during online transactions. This three-digit number is printed on the back of your card (in the signature area), immediately after the card number. In order to prevent fraudulent credit card transactions, these control digits will be requested to validate the transaction.
5.4. Invoice: FANCYHAUS will issue a receipt for each shipment, which will be provided in electronic format and sent to the email address you have provided.
6. Right of withdrawal
6.1. How to do it: you may cancel your order without giving any reason within 14 calendar days from the day you receive the purchased Products (or from the last Product, component, or part in the case of delivery of a Product consisting of multiple components or parts). This right shall not apply if the Product has been manufactured according to the specifications you have provided to us and is therefore a customized Product.
To this end, you must inform us of your decision to cancel your order. You must send your request to the following email address:

To this end, you may use the WITHDRAWAL FORM, which you will find at the end of these Terms and Conditions.
FANCYHAUS will confirm receipt of your request in writing and provide details on how to proceed with the return. You simply need to send your notification before the end of the 14-day withdrawal period and return the item as instructed in writing (customized products are exempt from these conditions and cannot be exchanged or returned).
FANCYHAUS will not be considered the owner of the returned product until it has been received at the return address.
6.2. Effects of withdrawal: FANCYHAUS will refund the price of the product, minus all delivery and/or return costs.
In addition:
a) You must return the Products following the instructions we provide you in writing within 14 days of the day on which you notified us of your withdrawal, unless we offer to collect the Products from the location you specify.
b) FANCYHAUS shall not be obliged to reimburse any additional costs arising therefrom.
c) FANCYHAUS will verify the condition of the returned Products. If the Product has not been unsealed and remains in its original packaging, or if the returned Product is in its original packaging but has been opened, removed from the packaging or is without packaging, assembled or used, but is in perfect condition, FANCYHAUS will refund the purchase price of the product, minus shipping costs, within 10 to 30 business days of receipt. In the event that FANCYHAUS offers to collect the Product, in any case the refund of the purchase amount must be made no later than fourteen (30) calendar days from the date of notification of your decision to withdraw.
If, on the other hand, the Products to be returned have been handled in such a way that they have suffered any type of damage that reduces their value, because they have been handled in a manner other than that necessary to check the nature, characteristics, and/or functioning of the Products, this will mean that in such cases the right of withdrawal will not be accepted.
d) Shipping costs to FANCYHAUS for returned Products will be at your expense and will therefore be deducted from the amount to be refunded, if you want FANCYHAUS to arrange the return shipping.
e) FANCYHAUS will use the same means of payment that you used for the initial purchase, unless another means is expressly agreed upon. In any case, you will not incur any surcharge that may arise from such reimbursement. We may withhold the reimbursement until we have received the items returned by you or until you provide proof of having returned the items, whichever occurs first.
7. After-sales warranty
In addition to your legal rights of withdrawal, if you are a customer in the European Union (excluding the United Kingdom), you will have an after-sales warranty valid for two years from the date of delivery of the Product, for the repair or replacement of products purchased from FANCYHAUS if they are defective or do not comply with what is advertised on our website.
In the event that the Products have any manufacturing defects, you will have the right to demand that FANCYHAUS to replace or repair them, unless one of these two options is objectively impossible or disproportionate. You must notify us of the defect within two months of noticing it. Once you have notified us of your chosen option, we will comply with it. Any option that is disproportionate for FANCYHAUS , taking into account the value of the Product.
Repairs or replacements will be free of charge to you and will be carried out within a reasonable time frame.
The price reduction and termination of the contract shall proceed, at your discretion, when repair or replacement of the Product is not possible or in cases where these have not been carried out within a reasonable period of time or without significant inconvenience to the consumer and user. Termination shall not proceed when the lack of conformity is of minor importance.
The price reduction will be proportional to the difference between the value that the Product would have had at the time of delivery had it been in accordance with the contract and the value that the product actually delivered had at the time of delivery.
8. Our responsibility
FANCYHAUS shall not be liable for:

losses that were not attributable to any breach on their part;

indirect or consequential losses that were not reasonably foreseeable by both parties at the time the contract for the sale of the Products was formalized between both parties.
Nothing in these Terms limits or excludes our liability for misrepresentation, or for death or personal injury attributable to our negligence or wilful misconduct.
FANCYHAUS shall not be liable for any delay or failure to perform its obligations under these terms and conditions if such delay or failure is attributable to circumstances beyond our reasonable control.
This provision does not affect your right to receive the product within a reasonable period of time. If the delay occurs prior to shipment of the Product, FANCYHAUS will not charge you any amount for said Product until it has been shipped to you, in which case you may cancel the order at any time prior to shipment.
9. Applicable law
These terms and conditions shall be governed by and interpreted in accordance with Spanish law, expressly excluding the application of the United Nations Convention on Contracts for the International Sale of Goods.
Both parties agree to submit to the non-exclusive jurisdiction of the courts of Barcelona (Spain). If you are a consumer and have your habitual residence in the European Union, you will also have the protection offered by any mandatory provisions of the legislation of your country of residence.

10. Modification of the terms and conditions of sale
We reserve the right to make changes to our website, our policies, and these Terms and Conditions of Sale at any time.
You will be subject to the terms and conditions, policies, and Conditions of Sale in force at the time you place your order, unless, by law or at the request of public authorities, a change must be made to those terms and conditions, policies, or these Conditions of Sale (in which case, such changes may apply to any orders you have placed previously).
If any of these conditions is declared invalid, void, or ineffective for any reason, that condition shall be deemed excluded without affecting the validity or enforceability of the remaining conditions.
11. Disclaimer
In the event of your breach of these Terms and Conditions, and even if FANCYHAUS decides not to exercise any rights available to it at that time, FANCYHAUS may exercise such rights and take such action on any other occasion on which you breach these Terms and Conditions of Sale.

13. Language
